Terms of Service

1. Acceptance of terms

By accessing or using Plotelle (the "Platform", "Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Platform. These Terms form a legally binding agreement between you and Badger IT LLC, the operator of Plotelle.

2. Description of service

Plotelle is an AI-powered platform that lets users submit creative concepts and ideas for graphic novels. Our AI system then generates graphic novel content — including visual panels, dialogue, and narrative — based on those submissions. Users may edit, refine, and download the generated content. AI-generated output is provided as a creative starting point; we do not guarantee any specific artistic style, narrative quality, or visual fidelity.

3. Eligibility and age requirements

The Platform is open to users of all ages, subject to the following:

  • Users under 13 must have verifiable parental or guardian consent before creating an account or submitting content.
  • Users 13–17 represent that they have obtained parental or guardian permission.
  • Users 18 and older may use the Platform subject to these Terms.

4. User accounts

4.1 Account creation

To access certain features you may need to create an account. You agree to provide accurate, current, and complete information and to keep it updated.

4.2 Account security

You are responsible for safeguarding your credentials. Notify us immediately of any unauthorized use. We are not liable for loss resulting from unauthorized access.

4.3 Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violation of these Terms or at our discretion.

5. Submissions and AI-generated content

5.1 Your submissions

"Submissions" means any ideas, prompts, text, descriptions, characters, storylines, or other content you provide. By submitting content you represent and warrant that:

  • You own or have the necessary rights to the submitted content;
  • Your submission does not infringe any third-party intellectual property rights;
  • Your submission does not violate any applicable law or these Terms.

5.2 License grant for submissions

By submitting content you grant Badger IT LLC a worldwide, non-exclusive, royalty-free, sublicensable, perpetual license to use, reproduce, modify, adapt, publish, and process your Submissions to (a) operate and provide the Service, (b) improve and train the Platform's AI systems (see Section 6), and (c) generate your requested graphic novel content.

5.3 Ownership of AI-generated content

  • You retain ownership of any original creative elements you provide in your Submission.
  • AI-generated output produced solely from your Submission, without meaningful human authorship, may not be eligible for copyright protection under current US law.
  • Elements you meaningfully edit or creatively contribute to may be eligible for copyright protection as to those specific contributions.
  • Plotelle does not claim copyright over your downloaded output, but does not warrant that the output is copyrightable by you.
  • Plotelle retains a license to generated output for the purpose of improving its AI systems.

6. AI training data consent

By using the Platform and submitting content, you acknowledge and agree that your Submissions — and the AI-generated content produced from them — may be used to train, improve, and develop the Platform's AI models. This means:

  • Your text prompts, story ideas, and creative inputs may be retained and used as training data;
  • The generated visual and narrative content produced from your Submissions may be included in AI training datasets;
  • Aggregated or anonymized versions of your Submissions may be shared with third-party AI development partners.

You may opt out of having your Submissions used for AI training by emailing badgeritllc@gmail.com with subject line "AI Training Opt-Out". Opting out does not delete data already used in training.

7. Prohibited content and conduct

You agree not to use the Platform to submit, generate, or distribute content that:

  • Is sexually explicit, pornographic, or obscene;
  • Depicts, promotes, or glorifies child sexual abuse material (CSAM) — zero-tolerance, reported to law enforcement and NCMEC;
  • Depicts graphic violence targeting a real, identifiable person;
  • Promotes hatred or violence against any group based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin;
  • Infringes the intellectual property rights of any third party;
  • Contains defamatory, harassing, or threatening content targeting real individuals;
  • Attempts to circumvent or reverse-engineer the Platform's AI systems;
  • Is submitted in violation of any applicable law.

8. Intellectual property — platform

All Platform technology, software, AI models, interface designs, trademarks, logos, and branding are the exclusive property of Badger IT LLC and are protected by applicable IP laws. Nothing in these Terms grants you any rights in the Platform's technology or branding.

9. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that: (a) the Platform will be uninterrupted or error-free; (b) AI-generated content will meet your expectations; (c) generated content does not infringe third-party rights; or (d) the Platform is free of viruses or harmful components.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BADGER IT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM. Our total aggregate liability shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred dollars ($100).

11. Indemnification

You agree to indemnify, defend, and hold harmless Badger IT LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from (a) your use of the Platform, (b) your Submissions, (c) your violation of these Terms, or (d) your violation of any third-party rights.

12. Governing law and dispute resolution

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any dispute shall first be subject to good-faith negotiation. If unresolved, disputes shall be settled by binding arbitration administered by JAMS in Phoenix, Arizona. Class action waiver: you agree that any arbitration will be conducted on an individual basis and not as a class, consolidated, or representative action.

13. Changes to terms

We may update these Terms at any time. We will notify registered users of material changes by email or a prominent Platform notice at least 30 days before the changes take effect. Continued use after the effective date constitutes acceptance.
